PRIVACY POLICY

Rational Acoustics does not collect personal user data from any of our Mobile Apps, including names, contact details, or device identifiers. Nor do we receive information from Apple about who has downloaded or installed our apps.

Our Mobile Apps may access your iOS device's microphone, but only after permission is granted. Access can be removed at any time from your device's Settings menu.  All data processing occurs locally on your device and any data you save will be saved only to your device. No data is copied or transmitted to external servers.

We do not use any tracking technologies to monitor your activity within our Mobile Apps and we do not share any user data with third-party services.

If you email us for support or other feedback, your emails and email address may be retained for quality assurance purposes. Your email address will be used only to reply to your support inquiry and will never be shared or used for any marketing purposes.

TERMS & CONDITIONS

Rational Acoustics grants you a limited, nonexclusive, non-transferable, and revocable license to install and use our Mobile Apps for your personal use on a single mobile device owned or otherwise controlled by you.

You may not:

  • Modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of the Mobile App; 
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Mobile App or any part thereof; 
  • Remove, delete, alter, or obscure any trademarks or any copyright, trademark, patent, or other intellectual property or proprietary rights notices from the Mobile App, including any copy thereof; 
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Mobile App, or any features or functionality of the Mobile App, to any third party for any reason, including by making the Mobile App available on a network where it is capable of being accessed by more than one device at any time; or 
  • Remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting the Mobile App.

When using our Mobile Apps on an Apple device ("mobile platform"), the following will apply:

  • The license granted to you when using the Mobile App is limited to a non-transferable license on a device that utilizes the mobile platform in accordance with the usage rules set forth in the mobile platform’s terms of service and any other applicable documents;
  • We are responsible for providing any maintenance and support services with respect to the Mobile App in regard to updates made by the mobile platform and in its day-to-day use;
  • Any refund requests or billing inquiries made by you for purchases made on the mobile platform must be requested through the mobile platform in accordance with its refund policy. We cannot assist in any refund requests or billing inquiries for payments made through the mobile platform;
  • As the jurisdiction and governing law of Rational Acoustics and our Mobile Apps app is the United States, you verify that:
    • You are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country; or
    • You are not listed on any U.S. government list of prohibited or restricted parties;
  • You must comply with applicable 3rd party agreements that are used in combination with your wireless plan, network connection, or any other data service or device agreement; and
  • You acknowledge that the mobile platform used in connection with the Mobile App will have the right to enforce its terms and conditions regarding your access and activities when using the Mobile App.

You acknowledge and agree that the Mobile App is provided under license, and not sold, to you. You do not acquire any ownership interest in the Mobile App under this Agreement, or any other rights thereto other than to use the Mobile App in accordance with the license granted. Company retains its entire right, title, and interest in and to the Mobile App, including all copyrights, trademarks, and other intellectual property rights therein or relating thereto.

By using our Mobile Apps, you agree to indemnify Rational Acoustics and hold Rational Acoustics harmless against legal claims and demands that may arise from your use or misuse of our Mobile Apps.

Rational Acoustics is not liable for any damages that may occur to you as a result of your misuse of our Mobile Apps.

By using Rational Acoustics Mobile Apps, you agree to our Privacy Policy and Terms and Conditions as outlined above.  We reserve the right to update the Privacy Policy and/or Terms and Conditions at any time. Please check this page periodically for updates. Your continued use of any of our Mobile Apps following such updates constitutes your acceptance of any and all updated terms. If you do not agree to the updated terms you must uninstall, and stop using, the Mobile App.
